Privacy Policy governs the question of use of mobile applications Harmonics, Ostinato and Glissando



 

The present Privacy Policy governs the question of use of mobile applications “Harmonics”, “Ostinato” and “Glissando”.


We put particular attention to protect the privacy of our clients, contractors and employees. One of its crucial aspects is the protection of rights and freedoms of natural persons with regard to the processing of personal data.


We take care that the processing of Your personal data is compliant with the provisions of the General Data Protection Regulation 2016/679/EU (hereinafter referred to as the GDPR), the act on the processing of personal data, as well as with the sector-specific provisions (contained among others in the act on providing services by electronic means or act on accountancy).
We are controllers of personal data in the meaning of art. 4 (7) of the GDPR, we also contracts data processors, referred to in art. 4 (8) of the GDPR – they process personal data on behalf of the controller (these are for instance accounting offices, IT or hosting companies).
We implement appropriate technical and organisational measures, in order to ensure the level of security appropriate to the possible risk to the rights and freedoms of natural persons of varying likelihood and severity. Our actions in the field of personal data protection are based on adopted policies and procedures, as well as on regular training improving knowledge and competencies of our employees in that field.
Cookies
1. The applications “Harmonics”, ”, “Ostinato” and “Glissando” hereinafter referred to as the “Application”, use Cookies and similar technologies for Your convenience, among others in order to adapt our service to the need of users and for statistical purposes. Cookies are small text files send by website to the user device.
2. Cookies are also used by websites that we refer to, for instance while showing multimedia. You can change the settings concerning Cookies in Your web browser. Lack of change of these settings results in acceptance of Cookies.
3. The Applications use performance cookies, which are used to collect information on the way of use of website, so it can run better, as well as functional cookies which “remember” the user settings (e.g. language, font size).
Personal data
4. The Controller of Your personal data, after the Application has been installed is Polskie Wydawnictwo Muzyczne (PWM Edition), with its registered office in Kraków (31-111), Krasińskiego 11A.
5. Your personal data will be processed by the Controller exclusively for the following purposes:
• on the basis of art. 6 (1) letter b) of the GDPR in order to conclude the contract on provision of services by electronic means, which terms are defined in the Terms of the services provided by electronic means, available here: https://pwm.com.pl/pl/page/regulamin_usude.html,
• on the basis of art. 6 (1) letter f) in order to pursue potential claims, due to our contract with You, or in order to defence against potential claims, as well as for our own marketing purposes, during our contract. These purposes constitute legitimate interests of the Controller.
6. The provided personal data will be disclosed to other entities. Apart from those having proper legal basis, especially to public authorities.
6. Personal data will be processed for the period of the contract execution as well as until time of prescription with relation to potential contractual claims expires.
8. You have right to request access to Your personal data from the Controller, their rectification, deletion or restriction of their processing, as well as right to object to processing and data portability right.
9. You have right to revoke the consent for processing data for the marketing purposes. From that moment on, we will not send You commercial information anymore.
10. You have right to object to processing on the basis of the legitimate interests of the Controller.
11. The Controller of the service has taken due care in order to properly secure the personal data that had been provided, especially against their disclosure to unauthorised persons.
12. Accountability, adequacy and fairness rules are taken into account while processing personal data.
13. You can lodge in a compliant with the supervisory office – the President of the Personal Data Protection Office.
14. Provision of data is the requirement for conclusion and execution of the contract.
15. Person under 13 years of age (person with limited legal capacity) can be the Party to the contract on providing services by electronic means, provided that its statutory representative has given consent.
16. Use of the application by minors under 13 years of age can occur exclusively on the basis of the contract entered into with its statutory representative.
