PWM Edition request that an offer/quotation be submitted for the subject of the contract, as referenced further below, by June 27, 2016. Please kindly make your offer in writing and have it sent out via email.

1. Subject of the inquiry (Appendix No. 1)

2. Terms of contract execution:

• The present enquiry pertains to the supply of a selection of music-themed gadgets, as indicated in the specification table by the Ordering Party (contract awarding entity). Specific types of gadgets shall be ordered successively as of the date of signing off the contract throughout the following 12 months, or until a specifically set budget, as set in the contract, has effectively been exhausted.

• Terms of delivery: all delivery costs shall be borne by the Ordering Party (contract awarding entity). Within three (3) days of the actual receipt of the delivery the Ordering Party shall run a quality check on the supplied goods, and subsequently confirm their acceptance via e-mail.

3. Validity of the offer/quotation:
Thirty (30) days.

4. Terms of Payment
Within thirty (30) days of the date of the invoice.

5. Offer assessment criteria:
The offer shall be assessed in terms of the overall value of the contract. – price 100%

7. How to have the offer/quotation structured:
Please make your offer regarding the subject of the contract in writing, and then have it sent out via e-mail.

The offer/quotation should comprise the following:
a) A completed offer form - fully compliant with the template enclosed as Appendix No 2 to the present inquiry. The Ordering Party (contract awarding entity) reserves the right to conduct an additional round of negotiations aimed at detailing the actual scope of the deal.
b) Valid extract from a relevant register, if applicable, in order to demonstrate absence of reasons for exclusion under art. 24 clause 1 item 2 of the Act; as regards natural persons - representations required under art. 24 clause 1 item 2 of the Act.
c) Representation on the absence of reasons for exclusion under art. 24 clause 1 of the Public Procurement Law Act – (representation template is appended hereto),
d) Representation of the Economic Operator on satisfaction of the requirements laid down in art. 22 clause 1 items 1 - 4 of the Public Procurement Law Act – (representation template is appended hereto),

9. Additional information:
a) The procedure for the award of a contract is not subject to the provisions of the Act of 29 January 2004, Public Procurement Law (Journal of Laws of 2015, Item 2164).
b) Any disputes that might arise with relation to the contract awarding procedure shall be resolved by the Ordering Party, which reserves the right to have the presently pursued procedure cancelled without providing any rationale.
c) Any attendant costs arising from the actual participation in the procedure shall be borne by the Contractor intent on securing the order, regardless of the actual outcome of the proceedings.
